The petitioner/wife has filed this transfer Civil Miscellaneous Petition seeking to withdraw H.M.O.P.No.87 of 2016 filed by her under Section 13(i)(ia) of the Hindu Marriage Act for divorce before the Subordinate Judge, Avinashi and transfer the same to the file of Family Court, Erode.

2. In paragraph 5 of the affidavit filed in support of the petition it is stated by the petitioner that she is living in Erode. She expressed difficulty in travelling to Avinashi to attend the hearings. Hence, she sought for the above transfer.

3. Heard the learned counsel for the petitioner as well as the learned counsel for the respondent.

4. It is stated that the respondent/husband is living in Kunnathur, Uthukuli Taluk and the petitioner/wife is also living in the same village.

5. However, now it is agreed by both the counsels that the above H.M.O.P. may be transferred to Subordinate Court, Perundurai, which would be convenient for both the petitioner and respondent.

6. Accordingly, the Transfer Civil Miscellaneous Petition is disposed of and H.M.O.P.No.87 of 2016, pending on the file of Subordinate Court, Avinashi shall stand withdrawn and transferred to the file of Subordinate Court, Perundurai.
