Respondents Prayer: Petition filed under Article 226 of the Constitution of India seeking a writ of certiorari mandamus, calling for the records of the respondents, especially the 3rd respondent his proceedings made in Na.Ka.No.AA2 / 199 / 2024 dated 28.02.2024 and Na.Ka.No.AA2 / 199 / 2024 dated 23.03.2024 and quash the same as null and void illegal and invalid and direct the respondents to conduct a proper enquiry.

ORDER

(Made by the Hon'ble Chief Justice) Heard Ms.V.Chellammal, learned counsel appearing for Mr.D.Padmanabhan, learned counsel for the petitioner and Mr.A.Edwin Prabakar, learned State Government Pleader assisted by Mr.T.K.Saravanan, learned Government Advocate for the respondents.

2. Learned counsel for the petitioner submits that directly, notice was issued for removing the encroachment. In fact, the petitioner has not encroached and the petitioner is the owner of the subject writ land.The petitioner has filed a reply to the said notice on 12.03.2024, however, only by changing the date, the same order is passed again.

3. The petitioner may file a detailed reply within a period of seven days from today along with the documents on which the

petitioner relies upon. If a reply is filed by the petitioner within seven days from today, then the Authorities shall consider the reply and the documents filed by the petitioner and take a decision afresh, considering the stand put forth by the parties.

4. The writ petition, accordingly, stands disposed of. There shall be no orders as to costs.
