Respondents Prayer: Petition filed under Article 226 of the Constitution of India, to issue a writ of mandamus, directing the first respondent herein to consider and pass orders on the petitioner's representation dated 11/01/2016, regarding conversion of the petitioner to the general line as Grade II Police Constable, on merits and in accordance with law, within a time-frame as deem fit and proper by this Hon'ble Court. O R D E R
The petitioner has come to this Court seeking issuance of a writ of mandamus directing the first respondent to consider his representation dated 11.01.2016, wherein he sought for conversion to general line as Grade II Police Constable, on merits and in accordance with law.
2.The petitioner joined in the police department as Bugler Police Constable on 18.01.2010. During his seven years of service, he has received about 20 rewards. That shows that he is maintaining a good and clean record of service for the past
seven years. As there is no distinction between a Bugler Police Constable and a regular Grade II Police Constable, which are also inter-changeable and the payment of salary and all other service benefits are also equivalent in respect of a Bugler Police Constable and a regular Grade II Police Constable, he has given a representation on 11.01.2016 to the third respondent requesting for his transfer to the general line/Armed Reserve as Grade II Police Constable, in the light of the circular memorandum in RC. No. 155370/RA5/80 giving guidelines and eligibility for transfer to general line/Armed Reserve. The third respondent, after entertaining his representation, has also made his recommendation and sent a proposal to the second respondent on 14.04.2016 in his proceedings No.
A2/103/1722/2016 and the second respondent also has verified the proposal submitted by the third respondent and forwarded the same to the first respondent by his proceedings Rc.No.Estt.II(1)/7467/2016 dated 21.06.2016. But till date no order has been passed. Therefore, he has been advised to come to this Court. 3.Mr.K.Thangapandian, learned Government Advocate, taking notice on behalf of the respondents, sought eight weeks time to consider the representation of the petitioner. 4.This Court directs the first respondent to consider the representation of the petitioner in the light of the proposal sent by the respondents 2 & 3 and to pass appropriate orders on the representation of the petitioner, within a period of six weeks from the date of receipt of a copy of this order. 5.
With this direction, the writ petition is disposed of accordingly. No costs.
