Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the first and second respondents to conduct survey and fix boundaries to the petitioner land situated at Kuniyur Village, Thiya Durgam Sub Division, Kallakurichi Taluk, Kallakurichi District, in Survey No.93/2B, to an extent of 2.06 Acres of Agricultural lands on the basis of the petitioner on-line application dated 28.10.2023 in Can No.133330725564579 and application No.2023/ 0105/ 33/ 453199 within a short time limit as directed by this Court. ORDER

With the consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.

2. This writ petition is filed to direct the first and second respondents to conduct survey and fix boundaries to the petitioner land situated at Kuniyur Village, Thiya Durgam Sub Division, Kallakurichi Taluk, Kallakurichi District, in Survey No.93/2B, to an extent of 2.06 Acres of Agricultural lands on the basis of the petitioner on-line application dated 28.10.2023 in Can No.133330725564579 and application No.2023/ 0105/ 33/ 453199 within a short time limit as directed by this Court.

3. Heard learned counsel for the petitioner and the learned Special Government Pleader appearing for the respondents and perused the materials available on record.

4. The case of the petitioner is that the petitioner and his son jointly purchased the subject property and joint patta has also been issued in their name. As the petitioner wanted to settle the property in favour of his son, he wanted to sub divide the land and fix its boundaries. In this regard, the 2/4

petitioner has given an on-line application to the respondents to survey his property and to fix its boundary. However, the respondents have not taken any action to survey his land. Hence, the present Writ Petition.

5. Considering the limited relief sought for in this writ petition, there shall be a direction to the respondents to dispose of the online application of the petitioner dated 28.10.2023 to survey the land of the petitioner and fix its boundaries after giving notice to the neighbouring land owners and any other interested persons, within a period of two months from the date of receipt of a copy of this order.
