The petitioner, who apprehends arrest at the hands of the respondent Police for the offences punishable under Sections 296(b), 115(2) and 351(2) of BNS r/w Section 4 of TN Prohibition of Harassment of Women Act, 2002, in Crime No.760 of 2026 on the file of the respondent police, seeks anticipatory bail.

The case of the prosecution is that the accused abused and assaulted the de facto complainant and threatened her with dire consequences. It is further alleged that the de facto complainant was subjected to harassment which resulted in injuries. Hence the case. 3.

Learned counsel appearing for the petitioner submitted that the petitioner is innocent and has been falsely implicated in this case. He further submitted that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prayed for the grant of anticipatory bail to the petitioner. 4.

Learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and opposed for the grant of anticipatory bail to the petitioner. He further submitted that this is the second application for bail filed by the petitioner and that there is no change in circumstances.

Heard both sides and perused the materials available on record. 6.

Considering the above facts and circumstances of the case, taking note of the nature of allegation and also considering that there is 2 / 4

no change in circumstances, this Court is not inclined to grant anticipatory bail to the petitioner.
