Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Declaration, declaring that the Deed of Bond executed by the petitioner on 28.09.2020 has been complied and the petitioner has completed the bond and consequently direct the 4th and 5th Respondents to return the original certificates of the petitioner and documents collected by the 5th respondent while admitting the petitioner to the post graduate degree course along with the Post Graduate degree certificates.

The instant writ petition has been filed with a prayer for issuing a Writ of Declaration, declaring that the Deed of Bond executed by the petitioner on 28.09.2020 has been complied and the petitioner has completed the bond and consequently direct the 4th and 5th Respondents to return the original certificates of the petitioner and documents collected by the 5th respondent while admitting the petitioner to the post graduate degree course along with the Post Graduate degree certificates. 2/6
2. Heard the learned counsel for both sides and perused the materials available on record.
3. Though the petitioner has come up with a Writ of Declaration, to return the original certificates on the ground that his Covid duty period would constitute in bond service.

However, the learned Government Advocate appearing for the respondents would submit that the petitioner completed his post graduation in May-2021 and his bond period was two years, which has to end on May2023, whereas subsequently, the Government has issued G.O.(Ms).No.351, Health and Family Welfare (MCA-1) Department, dated 27.10.2023, by and in which the two years bond period was reduced to one year. Therefore, his bond period has to end on May-2022, whereas though the posting order was given on 27.10.2023 well after the bond period. He has completed such one year period. Therefore, they have no objection to release the original certificates.

5. In view of the above fair submission, the respondents are directed to return all the original certificates to the petitioner, within a period of two weeks from the date of receipt of copy of this order.
6. With the above direction, the Writ Petition is disposed of. No costs. 19.08.2025 Index : Yes/No Speaking order /Non Speaking Order dm 4/6
