JUDGMENT

The learned counsel appearing for the appellant sought permission of this Court to withdraw this Civil Miscellaneous Appeal and has also made the following endorsement to that effect:

"I may be permitted to withdraw this CMA No.2177 of 2018 by seeking liberty of Court to contest the HMOP No.448 of 2024 filed by me before the lower Court."

2.In view of the endorsement made by the learned counsel for the appellant, this Civil Miscellaneous Appeal stands dismissed as withdrawn, reiterating without prejudice to the contentions being raised in HMOP No.448 of 2024 now pending before the Family Court, Coimbatore. 3.The Family Court, Coimbatore, may not be influenced by the fact that the present appeal has been withdrawn, but proceed to adjudicate HMOP No.448 of 2024 on merits and on the basis of records available in that particular Original Petition. No costs. Consequently, connected Civil Miscellaneous Petition is closed.
