Vivekanandan.K v. The State Rep By Its,

2023-05-04Honourable Mr Justice S. Sounthar3 pages

S.SOUNTHAR, J.

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 147, 148, 294(b), 323, 324 and 506 (ii) of IPC, in Crime No.84 of 2020, seeks anticipatory bail.

2. The case of the prosecution is that due to previous enmity, the petitioner along with other accused had attacked the defacto complainant and also threatened with dire consequence. Hence, the case.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he is no way connected with the alleged offence. He would further submit that, due to previous enmity, a false complaint has been lodged against him and hence, he prays to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl. Side) appearing for the respondent police submitted that the petitioner is an habitual offender and there are 14 previous cases pending against him and hence he vehemently opposed to grant anticipatory bail to the petitioner.

5. Heard both sides and perused the materials available on record.

6. Earlier application filed by the petitioner seeking anticipatory bail was dismissed on 01.08.2022 on the ground that the petitioner has got 14 previous cases. As there is no change of circumstances, this Court is not inclined to grant anticipatory bail to the petitioner. Hence, the anticipatory bail application is dismissed. 04.05.2023 dna/nti S.SOUNTHAR, J.,
