Apprehending arrest at the hands of the respondent police for the alleged offences punishable under Sections 380 of IPC in Crime No.Not Known of 2016 on the file of the respondent police, the petitioner has come forward with this petition seeking anticipatory bail. 2.

The case of the prosecution is that the petitioner is alleged to have committed the offence of theft of battery from Aircel Tower. Hence, a case has been registered against this petitioner. 3.

Learned counsel for the petitioner submitted that the petitioner is innocent and has been falsely implicated in this case. The petitioner is the owner of the vehicle and the driver hired vehicle from the petitioner and committed the said offence and the petitioner is in no way connected with the offence.

4. Learned Government Advocate (Crl.Side) submitted that the petitioner joined with others and committed the above said offence and the case property has not yet recovered.

Considering the facts and circumstances of the case and taking note of the fact that the case property has not yet recovered, this court is not inclined to grant anticipatory bail to the petitioner. Hence, this petition is dismissed.
