ORDER : The Court Made the following order :- The petitioner, who was arrested and remanded to judicial custody on 27.03.2021 for the offences punishable under Sections 170 and 420 of IPC in Crime No.382 of 2021, on the file of the respondent police, seeks bail.

2.The case of the prosecution is that on 17.03.2021, the defacto complainant gave his damaged diamond ring for repair to one Balamurugan & Selvaraj. On 18.03.2021, at about 1.00 PM the said Balamurugan informed over phone that some persons had cheated him and got the diamond ring from him. When the defacto complainant demanded the diamond ring, they escaped from the two wheeler and later the defacto complainant came to know that he was cheated by the petitioner in this case. Hence, the complaint. 3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he is no way connected in this case. Hence, he seeks to grant of bail to the petitioner.

4. The learned Additional Public Prosecutor strongly opposed this petition on the ground that there are two previous cases pending against the petitioner and the diamond ring is not recovered so far.

5. Taking note of the facts and circumstances of the case and the fact that the diamond ring has not been recovered and also the petitioner has two previous cases pending against him, this Court is not inclined to grant bail to him.

6. Accordingly, this Criminal Original Petition is dismissed. -sd/- 12/05/2021 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.) High Court, Madras - 600 104.
