Writ petitions are filed under Article 226 of the Constitution of India praying for a writ of mandamus to direct the respondents herein to regularize the service of the petitioners by considering the representation of the petitioners dated 23.12.2014 in the light of the recommendation of the 4th respondent dated 26.3.2013. C O M M O N O R D E R With the consent of the learned counsel appearing on either side, the Writ Petitions are taken up for final disposal at the admission stage itself.
2.The petitioners are working in the Public Works Department from 1996, 1997 & 1999 onwards. Now they are working under the control of the fourth respondent. The fourth respondent sent a recommendation dated 26.3.2013 to the third respondent for regularisation of the services of the petitioners. 3.In these circumstances, the petitioners have filed these Writ Petitions, seeking for a direction to the respondents to regularise their services in the light of the recommendation, as mentioned above.
4.In view of the limited scope of the prayer made, the third respondent is directed to send appropriate proposal based on the recommendation of the fourth respondent, referred to above to the second respondent within a period of four weeks from the date of receipt of a copy of this order and on receipt of such proposal, the second respondent is directed to pass orders thereon, within a period of four weeks thereafter. If the second respondent is agreeing with the proposal of the fourth respondent for regularisation of the services of the petitioners herein, the second respondent is directed to send necessary proposal to the first respondent, within a period of four weeks thereafter. On receipt of the proposal from the second respondent, the first respondent is directed to pass appropriate orders regularising the services of the petitioners within a period of eight weeks, thereafter.
The Writ Petitions are disposed of on the above terms. No costs.
