This Criminal Original Petition is filed under Section 439 of Cr.P.C praying to direct the Principal Sessions Judge and Special Judge for Prevention of SC & ST Atrocities Act, Coimbatore to consider the bail application on the same day on surrender of the petitioner in Crime No.3 of 2021 on the file of the respondent Police.

O R D E R

The relief sought for in this petition is to direct the Principal Sessions Judge and Special Judge for Prevention of SC & ST Atrocities Act, Coimbatore to consider the bail application on the same day on surrender of the petitioner in Crime No.3 of 2021 on the file of the respondent Police.

2. Heard the learned counsel on both sides.

3. Taking into consideration of the facts and circumstances of the case, the petitioner is directed to surrender before the jurisdictional Court within a period of six weeks from the date of receipt of a copy of this order. On such surrender, the Principal Sessions Judge and Special Judge for Prevention of SC & ST Atrocities Act, Coimbatore is directed to consider the petitioner's bail application and dispose of the same on merits and in accordance with law on the same day of surrender, after issuing notice to the defacto complainant under Section 15(A) of the SC/ST Act.
