Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the respondent to dispose the petitioner's appeal dated 23.12.2016 and consequently direct to release the petitioner's Lorry bearing registration No.TN-34-S-3034 seized by the Inspector of Police, Royakottai Police Station on 07.04.2016 at Bodampatti Division Road.

Mr.C.Jagadish, Special Government Pleader takes notice on behalf of the respondent. By consent of the parties, the main writ petition is taken up for final disposal at the admission stage itself.

2. The petitioner filed the writ petition seeking for a mandamus directing the respondent to dispose of the petitioner's appeal dated 23.12.2016, filed against the order of the SubCollector, Hosur dated 28.11.2016. Through the said order, the Sub-Collector, Hosur has imposed a fine of Rs.1,00,255/- on the petitioner, for release of the lorry bearing registration No.TN34-S-3034, on the ground that it has indulged in illicit transport of sand. The petitioner challenged the said order before the respondent, by way of an appeal dated 23.12.2016 and https://hcservices.ecourts.gov.in/hcservices/

the said appeal is still pending, not disposed of. Hence, the petitioner has approached this Court and filed this writ petition.

3. This Court, at this stage, without expressing any view on the merits of the claim made by the petitioner, only direct the respondent to dispose of the appeal on merits and in accordance with law, within a period of four weeks from the date of receipt of a copy of this order. Accordingly, this writ petition is disposed of. No costs.
