This Criminal Original Petition has been filed to direct the respondent to complete the investigation and file the final report in the above in Cr.No.466 of 2011 u/s 364 and 307 IPC on the file of the respondent.
2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the respondent.
3. On a perusal of the case diary, this Court finds that investigation is almost completed, but the respondent police have not filed the final report on the ground that they were not able to recover the vehicle, in which, the victim was abducted.
4. In the considered opinion of this Court, the case of the respondent police that they are not able to recover the vehicle cannot be a reason to keep the investigation pending. The fact that they were not able to recover the vehicle can be stated in the final report itself and it is suffice, if the victim gives evidence that he was abducted in certain vehicle.
