..Respondent(s) PRAYER: Writ Petition has been filed under Article 226 of Constitution of India praying to issue a writ of mandamus directing the respondent to pay the petitioners a sum of Rs. 18,050/- and Rs 18,500/- towards the STERBS (State Transport Employees Retirement Benefit Scheme) which was deducted from their salary for every month, while they were in service as admitted by the respondent in their RTI reply together with interest at the rate of 12 percent per annum within a specified time.

ORDER

The petition has been filed to direct the respondent to pay the petitioners a sum of Rs. 18,050/- and Rs 18,500/- towards the STERBS (State Transport Employees Retirement Benefit Scheme) which was deducted from their salary for every month, while they were in service as admitted by the respondent in their RTI reply together with interest at the rate of 12 percent per annum within a specified time.

2.It is the case of the petitioners that the petitioners joined the services in the respondent corporation and retired from service. Since, the amount deducted from their salary for every month, while they were in service as admitted by the respondent in their RTI reply, towards the STERBS (State Transport Employees Retirement Benefit Scheme) was not paid till date, the petitioners are before this Court.

3. Heard the learned Counsel on either side and perused the materials available on records.

4. Admittedly, the amount deducted towards the STERBS (State Transport Employees Retirement Benefit Scheme) has not been paid for no fault of the petitioners. Therefore, the petitioners are entitled to interest on the same.

Therefore, the Writ petition is allowed as prayed for and a mandamus is issued directing the respondent to disburse the sum of Rs.18,050/- and Rs.18,500/- deducted from their salary towards the STERBS (State Transport Employees Retirement Benefit Scheme), together with 6% interest from the date the amounts fell due till payment within a period of one (1) month from the date of receipt of a copy of this order. No costs. Connected miscellaneous petition is closed.
