Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus directing the respondents to reassess the answer sheets of the petitioner and provide him with a copies of the evaluated answer sheets print outs.

O R D E R

The petitioner has filed this writ petition seeking for a direction to the respondents to reassess the answer sheets of the petitioner and provide him copies of the evaluated answer sheet printouts.

2. The learned counsel appearing for the petitioner would submit that the petitioner has appeared for special online arrears examinations conducted by the respondent University in

the month of February, 2021 for all the 12 subjects and he has passed in one subject by securing distinction and insofar as other subjects are concerned, the petitioner did not secure pass marks and therefore, alleging that some mistake had occurred in uploading correct answer keys, the petitioner has filed the present writ petition seeking reassessment of the answer sheets.

3. Mr.L.P.Shanmugasundaram, learned Standing Counsel appearing for the respondents has produced the entire answer sheets pertaining to the petitioner before this Court.

Dr.P.Hariharan, Processor and Additional Controller of Examinations, Anna University and Dr.S.Lokesh, Deputy Controller of Examinations, Anna University appeared before this Court to assist the learned Standing Counsel for the respondents and they explained before this Court that the petitioner has completed B.E. (Computer Science and Engineering) Degree in the year 2016, with backlog of 12 papers and now the Government has given special permission to conduct arrears examinations during May 2020 and on account of Covid-19 pandemic, the examination was postponed to February, 2021 and the petitioner has appeared for the said special arrears examinations for 12 subjects. The Deputy Controller of Examinations, Anna University further submitted that same set of questions has been supplied to all the candidates and if the petitioner has correctly answered, the computer will award marks and if the answer is wrong, no marks will be awarded and since evaluation has been done digitally, there is no provision to re-assess the answer sheets.

This Court has perused the answer sheets pertaining to the petitioner and also satisfied with the explanation offered by the Additional Controller of Examinations and Deputy Controller of Examinations, Anna University and finds that there is no provision for revaluation of the answer sheets, as sought for by the petitioner.

In the light of the well settled legal position that this Court has no power to direct the authorities to revalue the answer sheets and coupled with the fact that the explanation offered by the Additional Controller of Examinations and Deputy Controller of Examinations, Anna University are found satisfactory, this Court is of the view that the prayer sought for by the petitioner cannot be granted and finds no merit in this writ petition.

7. The Writ Petition fails and accordingly, stands dismissed. No costs.
