Respondent Prayer: Writ Petition filed under Article 226 of the Constitution of India, seeking for a writ of mandamus directing the respondent to consider and dispose of the petitioner's representation dated 27.11.2015 regarding the record of foreclosure of the loan and for the issuance of no due certificate, cancellation of the mortgaged property Document No.4422/2005, registered with SRO, Avadi, Chennai and return of all the documents submitted at the end of respondent Bank.

ORDER

By consent, the writ petition is taken up for final disposal.

The petitioner states that he is employed in Southern Railway Printing Press, Royapuram, Chennai-600013 and is maintaining Savings Bank Account with the respondent / Bank, bearing Account No.063710011007270 and he approached the Bank for availing Housing Loan and it was also sanctioned in Housing Loan Account No.063730029001026. The grievance expressed by the petitioner is that though he has paid all the dues, the respondent / Bank is yet to issue 'No Due Certificate' as well as cancellation of the Mortgaged Property Documents bearing Document No.4422/2005, registered with SRO, Avadi, Chennai and also for return of the documents. In this regard, the petitioner has submitted a representation dated 27.11.2015 to the respondent and since he has not been https://hcservices.ecourts.gov.in/hcservices/

favoured with any response, the petitioner came forward to file this writ petition.

Heard the submissions of the learned counsel for the petitioner.

Though the petitioner has prayed for a larger relief, this court, in the light of the above facts and circumstances and without going into the merits of the same, directs the respondent to consider and dispose of the petitioner's representation dated 27.11.2015 on merits and in accordance with law and pass orders within a period of six weeks from the date of receipt of a copy of this order and communicate the decision taken, to the petitioner. The writ petition is disposed of accordingly. No costs.
