The petitioner who was arrested and remanded to judicial custody on 26.03.2024 registered by the respondent Police under Sections 273, 328 IPC and Sections 7(1), 20(2) of COTP Act, in Crime No.115 of 2024, seeks bail.
2.The case of the prosecution is that the petitioner along with other accused was found in illegal possession 1459 kgs of banned tobacco products worth about Rs.10,53,000/-. Hence the complaint. 3.The learned counsel for the petitioner would submit that the petitioner is an innocent person and based on the confession statement of the co-accused, he has been falsely implicated in this case. He would further submit the petitioner is prepared to abide by any stringent condition that may be imposed by this Court and therefore, he prays for grant of bail to the petitioner.

vkr products worth about Rs.10,53,000/-. He would also submit that the seized contraband is commercial quantity and the petitioner has not satisfied the conditions under Section 37 of NDPS Act. The investigation is not yet completed. Hence, he opposed for grant of bail to the petitioner.
5.Taking into consideration the facts and circumstances of the case and also taking note of the quantity of the contraband which is a commercial quantity and that the investigation is not yet completed, this Court is not inclined to grant bail to the petitioner. 6.Accordingly, this Criminal Original Petition stands dismissed.
