This Revision Petition is filed, aggrieved by the orders passed in I.A.No.2 of 2022 in R.L.T.A.No.153 of 2022 dated 12.01.2023 on the file of

the learned XV Additional City Civil Court, Madras.

2. It is submitted by the learned counsel for the petitioner that aggrieved by the orders passed in R.L.T.O.P.No.72 of 2022 dated 29.09.2022, the petitioner has preferred an Appeal in R.L.T.A.No.153 of 2022 and he has also moved an application, seeking to stay the execution of the orders passed in R.L.T.O.P.No.72 of 2022, until the Appeal has been disposed of. After a fullfledged hearing, the learned Trial Judge has dismissed the application.

3. When the matter was taken up for hearing, the learned counsel for the respondent who has filed Caveat, has strongly opposed to grant the relief as the Appellate Tribunal has dismissed the stay petition, considering the material records and on the ground, that the petitioner has approached the Tribunal belatedly.

4. The Appeal is stated to have been posted for arguments of the petitioner and the same is listed on 14.06.2023. As long as Appeal is pending, stay is required to be granted in order to maintain status quo.

5. Considering the circumstances, this Revision Petition is disposed of at this stage, granting stay of operation of R.L.T.O.P.No.72 of 2022 dated 29.09.2022, until the Appeal is disposed of by the Appellate Tribunal. It is for the Appellate Tribunal to expedite the disposal of the R.L.T.A.No.153 of 2022 as expeditiously as possible but not later than two months from the date of receipt of a copy of this order. No Costs. Consequently, the connected Miscellaneous Petition is closed.
