O R D E R
The petitioner, who was arrested and remanded to judicial custody on 12.08.2024 for the alleged offence under Section 8(c) r/w Section 20(b)(ii)(c), 25, 29 of Narcotic Drugs and Psychotropic Substances Act, 1/4
1985 in Cr.No.222 of 2024 pending on the file of the respondent police, seeks bail.
2. The allegations against the petitioner is that the accused persons were transported 55.600 kgs of ganja from Anangapalli to Trichy in Eicher Lorry bearing Regn.No.TN-12-BD-2985 and the same were seized by the respondent police.
3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that the petitioner has been in judicial custody from 12.08.2024 i.e., for more than two years. He further submitted that he is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

The learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and reported that this Court vide order dated 30.01.2025, dismissed the petitioner's earlier bail petition in Crl.OP.No.937 of 2025 on the ground that the quantity of contraband involved in this case is a commercial quantity, investigation is also not yet completed.

Though the learned counsel appearing for the petitioner submitted that final report filed and taken on file for trial, the seized contraband is commercial quantity and it attracts Section 37 of NDPS Act, except the long incarceration and allegation of false implications, no grounds to made out to satisfy under Section 37 of NDPS Act is made out, hence, this Court is not inclined to grant bail to the petitioner.
