ORDER
This Contempt Petition has been filed seeking to punish the respondent for his willful disobedience of the Order dated 15.03.2022 passed by this Court in Crl.O.P. No.5765 of 2022. 1/4
2.It is the case of the petitioner that he had filed Crl.O.P. No.5765 of 2022 seeking to direct the respondent to complete the investigation in Crime No.674 of 2021 on the file of the respondent police and to file a final report within the time frame fixed by this Court and this Court, by Order dated 15.03.2022, had directed the respondent to complete the enquiry and file a final report within a period of six months from 15.03.2022. It is the further grievance of the petitioner that since the respondent had not filed the final report as directed by this Court, the petitioner has come up before this Court with this Contempt Petition. 3.Today, there is no representation for the petitioner. Learned Government Advocate appearing for the respondent would submit that this Court by Order dated 15.03.
2022 had directed the respondent to complete the enquiry and file a final report within a period of six months from 15.03.2022. However, since the accused was absconding, the respondent was unable to comply with the order passed by this Court and that there is no willful disobedience on the part of the respondent. He would submit that with much pains, the respondent had taken steps to secure the accused Ravi Prasad on 11.08.
to custody and thereafter, the investigation has been completed and the final report was filed before the XVII Metropolitan Magistrate, Saidapet, Chennai on 21.09.2024. He would further submit that the case has been taken up in C.C. No.1968 of 2024 and the accused is also still in custody. 4.Recording the fact that the order of this Court dated 15.03.2022 has been complied with and this Court, finding that there is no willful disobedience on the part of the respondent, is inclined to close this petition.
