Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the second respondent to dispose the petitioner's appeal dated 05.03.2023 to rectify the error in patta No.455 and survey the petitioner's land as per sale deed in Doc.No.281/1958, Sub Registrar, Omalur.

ORDER

With the consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.

2. This writ petition is filed to direct the second respondent to dispose the petitioner's appeal dated 05.03.2023 to rectify the error in patta No.455 and survey the petitioner's land as per sale deed in Doc.No.281/1958, Sub Registrar, Omalur.

3. Heard learned counsel for the petitioner and the learned Special Government Pleader appearing for the respondents 1 to 3 and perused the materials available on record.

4. The case of the petitioner is that the mother of the petitioner purchased the subject property to an extent of 92 cents by way of registered sale deed dated 07.02.1958 and after the death of his mother, the petitioner is enjoying the property. But the third respondent issued computerized patta only for an extent of 75 cents instead of 92 cents. Hence, the petitioner made an appeal petition dated 05.03.2024 to the respondents 1 and 2 to rectify the error and the same has not been considered till date. Hence, the present Writ 2/5

Petition.

Considering the limited relief sought for in this writ petition, the second respondent is directed to dispose of the petitioner's appeal and pass appropriate orders on the same on its own merits and in accordance with law dated 05.03.2023 and to rectify the error in patta No.455 and survey the petitioner's land as per sale deed in Doc.No.281/1958, Sub Registrar, Omalur within a period of two months from the date of receipt of a copy of this order.
