O R D E R

The petitioner who was arrested on 30.11.2020 and remanded to judicial custody for the offences punishable under Section 354 IPC and Section 9(n) r/w 10 of POCSO Act 2012, in Cr.No.11 of 2020 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner had sexually assaulted the daughter of the defacto complainant, who is aged about 4 years. Hence, the complaint was registered.

3. The learned counsel for the petitioner submitted that the petitioner is no way connected with the alleged offence and he has been falsely implicated in this case and the petitioner has been in jail from 30.11.2020. days Therefore, he prays to grant bail to the petitioner.

4. The learned Government Advocate (Crl.Side) would submit that the trial is commenced and five witnesses have been examined. He would further submit that if the petitioner is released on bail, he may flee. Hence, he vehemently opposed for grant of bail to the petitioner.

5. Having regard to the nature of allegations and considering the fact that the trial is commenced and five witnesses have been examined including the victim, this Court is not inclined to entertain this petition.

6. Accordingly, this Criminal Original Petition is dismissed with a direction to the trial Court to complete the trial in Crime No/11 of 2020 as expeditiously as possible.
