Petition praying that in the circumstances stated therein the High Court will be pleased to relax the condition imposed upon the petitioner to report before the respondent police daily at 10.30 am until further orders in Crl.OP.No.8340/2021 by order date 30.04.2021 by this Honble Court in Cr.No.8/2021 on the file of respondent police.
Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.N.SRINIVASA RAGHAVAN Advocate for the petitioner and of MR. S.KARTHIKEYAN, ADDITIONAL PUBLIC PROSECUTOR on behalf of the Respondent the court made the following order:- The Petitioner has filed this petition seeking to relax the condition imposed by this Court in Crl.O.P.No.8340 of 2021 for the offences punishable under Section 120(b), 294(b), 307, 379 and 506(ii) of IPC in Crime No.8 of 2021, while granting bail.
2. Learned counsel for the petitioner submitted that the petitioner is a resident to Bangalore and hence, he failed to comply with the conditions imposed by this Court while granting bail on 30.04.2021 and therefore, he seeks relaxation. 3.The learned Additional Public Prosecutor opposes this petition on the ground that though this Court, while granting bail on 30.04.2021, has directed the petitioner to report before the respondent police daily at 10.30 am until further order, the petitioner has complied with the conditions only from 05.05.2021. https://hcservices.ecourts.gov.in/hcservices/
4.Considering the facts and circumstances of the case and the prevailing Covid-19 Pandemic situation and also the fact that the petitioner is a permanent resident of Bangalore, this Court is inclined to modify the condition by directing the petitioner to appearing before the respondent police as and when required for interrogation on receipt of summons.
