This Criminal Original Petition has been filed praying direct the third respondent Police to take appropriate action on the complaint dated 06.08.2015 made by the petitioner by registering an FIR.

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondents.

3. On a reading of the complaint, it appears that the dispute is among the brothers in respect of sale, that has taken place in the year 2007, in which it is alleged that this petitioner was not given his due share.

4. Under such circumstances, no positive direction can be issued to the Police to register an F.I.R., as the complaint does not disclose commission of cognizable offence. Hence this Criminal Original Petition is closed with liberty to the petitioner to work out his remedy in the manner known to law.
