Respondents Prayer : - Second Appeal has been filed under Section 100 of C.P.C against the judgement and decree dated 22.04.2003 made in A.S.No.44 of 2002 on the file of the Additional District Court, Fast Track Court V, Coimbatore at Tirupur, reversing the judgment and decree dated 23.03.1999 made in O.S.No.354 of 1995 on the file of the District Munsif Court, Tirupur. For the appellant : Mr.S.S.Swaminathan For the Respondents : No appearance

JUDGMENT

This matter has been adjourned for enabling the appellant counsel to take steps for the deceased appellant. It is found that the death of the appellant has been intimated way back on 12.10.2017 and despite the same, no steps have been taken to implead the legal representatives of the deceased appellant and proceed with the matter further.

2. It is also found that the legal representatives of the appellants are not interested in prosecuting the matter any further. Therefore it is found that there is no purpose in keeping the matter further pending.

3. Resultantly, the Second Appeal is dismissed as abated. No costs. Consequently connected miscellaneous petitions, if any are closed.
