Respondents Writ Petition filed under Article 226 of the Constitution of India seeking issuance of a Writ of Mandamus directing the first respondent to register the sale certificate executed on 19.03.2025 in favour of petitioner before the 2nd respondent, the jurisdictional Sub Registrar, within a stipulated time that may be fixed by this Court and in furtherance thereof to appoint an Advocate Commissioner to present the sale certificate dated 19.03.2025 executed by the first respondent before the second respondent for registration.

O R D E R

This writ petition has been filed seeking issuance of a writ of mandamus directing the second respondent to register the sale certificate executed on 19.03.2025 by the first respondent and to release the document.

2. Heard Mr.K.N.Nataraaj, learned counsel for petitioner and Mr.U.Baranidharan, learned Special Government Pleader appearing for second respondent.

3. Learned Special Government Pleader appearing on behalf of the second respondent produced the written instructions received from the second respondent. On going through the same, it is seen that the petitioner had appeared before the second respondent and had sought for registration of the document. However, there was some commotion since there was an argument between the petitioner and others, who have come to the registration office. Thereafter, the sale certificate was never 2/4

presented for registration and hence, there was no occasion for the second respondent to consider the same.

4. Taking into consideration the facts and circumstances of the case and considering the materials placed before this Court, there shall be a direction to the petitioner and the first respondent to present the sale certificate for registration before the second respondent and the second respondent shall register the same, if it is otherwise in order. This writ petition is disposed of with the above direction. No costs.
