ORDER

The petitioner has filed this contempt petition to punish the respondent for his willful, intentional and flagrant violation of the order passed by this Court dated 15.11.2018 made in W.P.No.30040 of 2018.

2. A status report has been filed before this Court by the Superintendent of Police, CBCID, Chennai.

3. The relevant portions of the status report is extracted hereunder:

I submit that as per the order of this Hon'ble High Court, I have enquired the case and ascertain ground situation and thereby instructed he Inspector of Police, Velipalayam Police Station to register FIR and to do the investigation of this matter. Accordingly, a case was registered in Velipalayam Police Station Crime No.26 of 2019, U/s.387, 506(ii) IPC against the accused persons [A-1 to A-6] on 21.1.2019 at about 18.00 hours by Tr.Sivaprakasam, the Inspector of Police, Velipalayam Police Station, and taken up the case for investigation.

7. I submit that based on the complaint lodged by the petitioner, FIR was registered and the Inspector of Police, Velipalayam P.S. Have conducted investigation of this case. He has examined the Defacto complainant and other 5 witnesses and recorded their statements.

8. I submit that as per Police Note No.SC/16/2019, Home [SC] Dept. Dated 28.06.2019, I have relieved on 29.06.2019 from the Nagapattinam District and joined as Superintendent of Police, CBCID, Chennai.

I submit that now I have ascertained from the Inspector of Police, Velipalayam P.S. about the status of this case and it is learnt that he has conducted detailed and elaborte investigation, on 15.7.2019, the Inspector of Police, Velipalayam P.S. Have filed Charge sheet against before the Judicial Magistrate Court No.II, Nagapattinam and the same is yet to be taken on file.

10. I submit that after registration of the FIR peaceful situation is prevailing in Nambiyarnagar area and the petitioners are peacefully carrying operation in his village and no threat made by the counter parties.

3. This Court is of the considered view that, in view of all the subsequent developments, no further orders are required to be passed in this petition except recording the facts stated in the status report.
