ORDER
(This case has been heard through video conference) The petitioners, who apprehend arrest at the hands of the respondent police for the alleged offences punishable under Section 21(4) of Mines and Minerals (Development and Regulation) Act, in Crime No.169 of 2021, on the file of the respondent police, seek anticipatory bail.
2. It is the case of the prosecution that the petitioners have illegally transported 3 units of sand in two tipper lorries and JCB. Hence the complaint.
3. The learned counsel appearing for the petitioner would submit that the petitioners are innocent persons and they have been falsely implicated in this case. Hence, he prays to grant anticipatory bail to the petitioners.
4. The learned Government Advocate (Crl. Side) appearing for the respondent submitted that the petitioners have transported 3 units of sand illegally in two lorries and JCB without valid permission from https://hcservices.ecourts.gov.in/hcservices/
the Government from a patta land. He would also submit that the petitioners are the drivers of the lorry and JCB. The owner of the lorry as well as the petitioners are absconding and the investigation is also pending. Hence, he vehemently opposed for grant of anticipatory bail to the petitioner.
5. Considering the fact that the accused are absconding and the investigation is still pending, this Court is not inclined to grant anticipatory bail to the petitioner and accordingly, this Criminal original petition stands dismissed.
