O R D E R

This Criminal Original Petition has been filed seeking to call for the records pertaining to Crime No.54 of 2024 on the file of the AWPS (Central) Coimbatore and to quash the same.

2. Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl.Side) appearing for the first respondent-Police and perused the materials available on record.

3. Learned counsel for the petitioner submitted that there is no prima facie material available as against the petitioner. The petitioner has been falsely implicated in this case and he is no way connected with the alleged complaint. The de-facto complainant admitted the relationship with the petitioner. She herself admitted in the complaint that she has given up the relationship. Hence there is no necessity to conduct investigation. Therefore, the petitioner has filed this criminal original petition to quash the F.I.R in Crime No.54 of 2024, dated 14.02.2024.

4. The learned counsel for the respondent/de-facto complainant has submitted that the petitioner made a false promise that he would

marry the de-facto complainant and had physical relationship with her. Though each of them left some time, once again, after one year, the petitioner approached the defacto complainant and they had physical relationship. Since the petitioner made a false promise to marry her, the de-facto complainant has given consent for the physical relationship. Thereafter, the petitioner cheated the de-facto complainant and married other woman. Hence, the complaint.

5. Considering the facts and circumstances of this case, this Court is not inclined to quash the F.I.R. in Crime No.54 of 2024 on the file of the respondent-Police. Hence, this criminal original petition is dismissed. Both the petitioner and the private respondent are directed to extend their co-operation to the respondent-police to conduct investigation. The respondent Police is directed to conduct investigation and file a charge sheet within a period of three months.

6. With the abovesaid direction, this Criminal Original Petition is dismissed. Consequently, connected miscellaneous petition is also

dismissed.
