O R D E R
This Civil Revision Petition has been preferred seeking a direction to dispose the suit in O.S.No.6539 of 2019 pending on the file of the VII Additional City Civil Court, Chennai within a prescribed time limit.
2. Heard the learned counsel for the petitioner and perused the materials available on record.
3. The revision petitioner is the plaintiff, who filed a suit in Page No.2/5
O.S.No.6539 of 2019 for declaration of several sale deeds as null and void and also for partition.
4. It is seen from the case diary that the matter has been repeatedly posted for evidence and thereafter, reserved for judgment.
5. The learned counsel for the petitioner submitted that when the matter was posted for judgment, the respondents/defendants have filed an Interlocutory Application to re-open and re-call the case for cross examination of P.W.1 and even for that the revision petitioner had given no objection. In that case, it would have helped for an early disposal, had the learned trial Judge allowed the application filed to re-open and re-call P.W.1 and completed the cross examination and taken the proceedings to the next stage.
6. In view of the long pendency of the matter and the application filed at the stage when the matter was reserved for judgment, a direction should be given to the learned VII Additional Judge, City Civil Court, Page No.3/5
Chennai to dispose of the matter as expeditiously as possible.
7. In the result, this Civil Revision Petition is disposed of. The learned VII Additional Judge, City Civil Court, Chennai is directed to dispose of the suit in O.S.No.6539 of 2019 as expeditiously as possible. No costs.
