J U D G M E N T

The appeal has been filed against the preliminary decree in O.S.No.35 of 2006 which was confirmed in A.S.No.63 of 2007.

2. Mr.P.Kaviri Nadan, learned counsel representing Mr.N.Manokaran, learned counsel for the appellants would submit that pending appeal, a compromise has been arrived at between the parties in the final decree proceedings in I.A.No.216 of 2007 and the said compromise was also recorded by the learned Sub-Judge, Sankari on 21.12.2009.

3. In view of the said compromise nothing survives in this appeal and hence the appeal is dismissed as it having become infructuous. No costs. Consequently, connected M.P is closed.
