Prayer: Writ Petition under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, directing the respondents to consider the representation of the petitioner dated 17.01.2026 and to process the passport application of the petitioner in file No.MA8075655698225 and to issue passport to the petitioner within a time stipulated by this Court. O R D E R
This Writ Petition has been filed to direct the respondents to consider the representation of the petitioner dated 17.01.2026 and process the passport application of the petitioner in file No.MA8075655698225 and to issue passport to the petitioner within a time stipulated by this Court.
2. The case of the petitioner is that the petitioner applied for renewal of the passport issued by the first respondent on 08.09.2025, however, the respondent issued a show cause notice dated 11.10.2025 stating that a criminal case in F.I.R.No.36 of 2020 was pending which was registered on account of unfortunate road accident that occurred on 07.03.2020 when the petitioner was returning to Thiruvannamalai along with his family members in car, in which, the petitioner's aunt, namely, Vijayalakshmi died due to head injury. Thereafter, the final report has been filed before the lower Court and while pending the case before the trial Court, the petitioner filed quash petition in Crl.O.P.No.34293 of 2025 before this Court and this Court quashed the case vide order dated 19.12.2025. Hence, the petitioner has made a representation on 17.01.2026 to
the first respondent requesting to process the application made by the petitioner and to issue passport, however, the same has not been considered. Hence, the present writ petition has been filed.
3. The learned counsel appearing for the petitioner submitted that it would suffice, if the first respondent is directed to dispose of the representation of the petitioner dated 17.01.2026 on merits and in accordance with law, within a specified period.
4. Heard the learned counsel appearing for the petitioner, the learned Central Government Standing Counsel appearing for the first respondent and the learned Government Advocate (Crl.side) appearing for the second respondent.
5. In view of the limited request made by the learned counsel appearing for the petitioner, this Court, without going into the merits of the case, directs the first respondent to consider the representation of the petitioner dated 17.01.2026 and pass appropriate orders on merits and in accordance with law within a period of six weeks from the date of receipt of a copy of this order.
6. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs.
