O R D E R

The Civil Revision Petition is taken up for final disposal at the admission stage itself.

2.According to the revision petitioner, the petitioner has filed an Interlocutory Application in I.A.No.1381 of 2017 in O.S.No.255 of 2015 to set aside the Commissioner's report dated 16.07.2016 filed in I.A.No.744 of 2015. The aforesaid I.A.No.1381 of 2017 is still pending before the Court below for seeking the aforesaid prayer.

3.Heard the learned counsel for the revision petitioner and perused the materials available on record.

4.By considering the above said facts and the contention of the revision petitioner, without expressing any opinion on merits, this Court is inclined to direct the Subordinate Judge of the Nilgiris, Udhagamandalam, to dispose of the I.A.No.1381 of 2017 in O.S.No.255 of 2015 on merits and in accordance with law as expeditiously as possible preferably within a period of three months from the date of receipt of a copy of this Order.

5.The Civil Revision Petition is disposed of with above direction. No costs. Consequently, the connected Miscellaneous Petition is closed.
