CMP No.3914 of 2023 in CMA SR No.47751 of 2022 N.ANAND VENKATESH,J The first respondent, who was set ex parte before the Tribunal below, died and his legal heirs were already on record as respondents 3 to 5. Notice has been served on respondents 3 to 5 and their names have been printed in the cause list. After service of notice, the second respondent entered appearance through a counsel.

2. This civil miscellaneous petition has been filed seeking to condone the delay of 824 days in filing the main civil miscellaneous appeal.

3. Heard the learned counsel for the petitioners/appellants and the learned counsel for the second respondent and perused the records.

4. Having satisfied with the reasons assigned in the affidavit filed in support of this petition, the civil miscellaneous petition is allowed and the delay of 824 days is condoned.

5. It is made clear that for the period of delay of 824 days, the petitioners/ appellants will not be entitled for any interest in the event of this Court enhancing the amount of compensation fixed by the Tribunal below.

6. Registry is directed to number the main civil miscellaneous appeal and list the same for admission. When the matter is posted for admission, the name of learned counsel for second respondent shall also be printed in the cause-list.
