ORDER

The petitioner apprehends arrest for the alleged offences under Sections 296(b), 118(1), 351(3) of BNS Act, in Crime No.46 of 2026 on the file of the respondent police seeks anticipatory bail.

2. The allegation against the petitioner is that on 11.02.2026 at about 9.45 a.m, while the defacto complainant was in her shop, the petitioner was selling banned liquor bottles nearby. On account of the same, a wordy quarrel arose between them. During the course of the said quarrel, the petitioner attacked the defacto complainant and caused sustained injuries to her. Hence, a case has been registered against the petitioner.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent and she has been falsely implicated in this case and she has not committed any offence as alleged by the prosecution. He further submitted that she is ready to abide by any conditions that may be imposed by this Court and that she is ready to cooperate with the investigation. Hence, he prayed to grant anticipatory bail to the petitioner.

Per contra, the learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and, upon instructions, submitted that the petitioner has three previous cases pending against her. He further submitted that when the defacto complainant questioned the illegal activities of the petitioner, the petitioner assaulted her and caused grievous injuries.

5. I have given my anxious consideration to either side submissions.

6. Considering the nature of the allegations, the injuries sustained by the defacto complainant and the antecedents of the petitioner, this Court is not

inclined to enlarge the petitioner on anticipatory bail. Accordingly, this Criminal Original Petition is dismissed.
