PRAYER: This Criminal Original Petition has been filed under Section 483 & 528 of BNSS Act, to modify the condition imposed by the Hon'ble Principal District and Sessions Judge, Chengalpattu in Crl.M.P.No.476 of 2025 dated 13.03.2025 i.e., (1) the petitioner/accused is directed to deposit a sum of Rs.50,000/- (Rupees Fifty Thousand only) into the account of the District Munsif cum Judicial Magistrate, Thirukalukundram and (3) the petitioner/accused is directed to report before the respondent police daily at 10.30 a.m., for a period of 30 days.

ORDER

The petitioner seeks modification of the condition imposed by the Hon'ble Principal District and Sessions Judge, Chengalpattu, in Crl.M.P.No.476 of 2025 dated 13.03.2025, i.e., (1) the petitioner/accused is directed to deposit a sum of Rs.50,000/- (Rupees Fifty Thousand only) into the account of the District Munsif cum Judicial Magistrate, Thirukalukundram and (3) the petitioner/accused is directed to report before the respondent police daily at 10.30 a.m., for a period of 30 days and thereafter as and when required for the interrogation.

The learned counsel for the petitioner submitted that the petitioner is unable to deposit a sum of Rs.50,000/- (Rupees Fifty Thousand only) imposed by the trial Court in Crl.M.P.No.476 of 2025 dated 13.03.2025; that all the properties of the petitioner were recovered; and that the petitioner has no bad antecedents.

however, submitted that the petitioner is a financier who had issued a loan to the accused persons. Therefore, the averments in the petition cannot be accepted.

In view of the aforesaid facts, the conditions (1) and (3) imposed on the petitioner in Crl.M.P.No.476 of 2025 dated 13.03.2025 are modified, directing the petitioner to deposit a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) to the credit of Crime No.281 of 2024 and to appear before the respondent police daily at 10.30 a.m., for a period of fifteen days and thereafter as and when required for the interrogation. The other conditions imposed in the order dated 13.03.2025 in Crl.M.P.No.476 of 2025 shall remain unaltered.

5. Accordingly, the criminal miscellaneous petition is ordered, and the conditions are modified.
