ORDER

The petitioner apprehends arrest for the alleged offence under Sections 8(c), 22, 23, 28 and 29 of NDPS Act, 1985 in Crime No. Unknown of 2026 on the file of the respondent police seeks anticipatory bail.

2. The case of the prosecution is that when the petitioner intercepted at Mumbai Airport, she was frisked and found that no incriminating materials were found in her body or any of her belongings. The petitioner has been receiving summons from the Superintendent of Customs, Meenambakkam Airport and the summons discloses about the registration of FIR under section 8(c), 22, 23, 28 and 29 of NDPS Act, 1985.

3. The learned counsel for the petitioner submitted that the petitioner was innocent and that she has been falsely implicated in this case. She further submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court and she is ready to co-operate for investigation. Hence, she prays to grant anticipatory bail to the petitioner.

4. The learned Special Public Prosecutor strongly opposed the bail application as the charge against the petitioner is serious offence in NDPS Act. Hence, he opposed the grant of anticipatory bail to the petitioner.

5. I have given anxious consideration to the submissions made by the learned counsel on either side.

6. Considering the facts and circumstances of the case and taking into consideration of the severity of the allegation and the nature of offences

involved in this case, this Court is of the firm view, that the petitioner does not deserve any anticipatory bail. Hence, this Court is not inclined to enlarge the petitioner on anticipatory bail.

7. Accordingly, this Criminal Original Petition is dismissed. 08-04-2026 SHL To:
