Original petition Application praying that this Hon'ble Court be pleased that a Succession certificate may be granted to and in favour of the 2nd Petitioner, Mr.N.P.Jegannathan with power to collect the securities and receive the same with interest, bonus and dividends on and negotiate and transfer and sell the securities specified in the schedule.

This Original Petition coming on this day before this court for hearing, the court made the following order: The Original petition has been filed seeking succession certificate for the estate of one N.Parthasarathy alias Parthasarathy Nelvoy, who has died intestate on 07.10.2007. The original petition was filed by 3 petitioners, who are the sons and daughter of the deceased.

Evidence was also recorded.

The first petitioner has examined as P.W.1, he has produced the death certificate of Mr.N.Parthasarathy as Ex.P2. It is also seen from the Ex.P1, wife of Mr.N.Parthasarathy, predeceased him on 01.05.1998. The legal heirship certificate of the deceased Mr.N.Parthasarathy has also been marked as Ex.P3, it shows that the 3 petitioners alone are his legal heirs.

2.During the pendency of this petition, the first petitioner Mr.N.P.Ragunathan had died, the legal heirs of the first petitioner have brought on record as petitioners 4 to 6. The prayer in the petition is also amended seeking issuance of succession certificate infavour of the 2nd petitioner, Mr.N.P.Jagannathan. A paper publication has also been made.

3.In view of the same, the application is allowed, the succession certificate is issued infavour of the 2nd petitioner in respect of the securities specified in the schedule to the said petition.
