ORDER

This Arbitration Original Petition has been filed under Section 11(5) &

(6) of the Arbitration and Conciliation Act, 1996 to appoint a Sole Arbitrator to appoint a substitute Sole Arbitrator to arbitrate the dispute between the

Petitioner and the Respondent arising out of the Letter of Employment Agreement, dated 05.03.2020.

2. Heard the learned counsels appearing on either side.

3. This Court, by its order dated 15.09.2023 made in Arb.O.P.No.62 of 2023 had appointed Thiru V.Ramasamy, Retired District Judge, as the sole Arbitrator to adjudicate the disputes between the parties.

4. The Arbitrator had entered upon reference, where pleadings were completed, the claimant proof affidavit filed and the matter was at the stage of marking of documents. While that being so, the Arbirator by his letter dated 10.01.2023, addressed to both the parties had recused himself from the arbitration proceedings due to his ill health. Hence, both the parties have approached this Court to substitute an Arbitrator in the place of Thiru V.Ramasamy, Retired District Judge,.

5. I have considered the submissions made by the learned counsels appearing on either side and perused the materials available on record.

6. Considering the fact that Thiru V.Ramasamy, Retired District Judge, had recused himself from the arbitration proceedings due to his ill health, this

Court hereby appoints Mr.J.V.Raj, Retired District Judge, (Phone No: 9445436345 & 9442544255) residing at No.46, Sathya Nagar, Near Reeds School, Mylampatti, Coimbatore - 641 062 as Sole Arbitrator to enter upon the reference and resolve the disputes between the petitioner and the respondent. 7.

The learned Sole Arbitrator is entitled to fix his fees as per the Schedule-IV of the Act. This Court further requests the learned Sole Arbitrator to endeavour to decide the dispute as expeditiously as possible.
