PRAYER: Transfer Civil Miscellaneous Petition filed under Section 24 of the Code of Civil Procedure, to withdraw the petition H.M.O.P No. 6 of 2013 from the file of Sub Court, Tiruppattur and to transfer the same to the file of Sub Court, Dharmapuri.

O R D E R

This Transfer Civil Miscellaneous Petition has been filed by the petitioner to withdraw the petition in H.M.O.P No. 6 of 2013 from the file of Sub Court, Tiruppattur and transfer the same to the Sub Court, Dharmapuri.

2. Heard the learned counsel for the petitioner and the learned counsel for the respondent.

3. The petitioner is a resident of Dharmapuri. The respondent instituted a proceedings before the Sub Court, Tiruppattur in H.M.O.P No. 6 of 2013. According to the respondent, she is residing at No.C-15, ASTC Quaters, Pennagram Main Road, Dharmapuri and as such, it would not be possible for her to travel to Tiruppattur, for the purpose of defending the proceedings in H.M.O.P No. 6 of 2013.

4. Considering the submissions made on either side, H.M.O.P.No.6 of 2013 is withdrawn from the file of Sub Court, Tiruppattur and is transferred to Sub Court, Dharmapuri. A direction is issued to the Sub Court, Dharmapuri to renumber the original petition and dispose of the same, on merits and in accordance with law, as expeditiously as possible. https://hcservices.ecourts.gov.in/hcservices/

5. The Transfer Civil Miscellaneous Petition is allowed.

No costs. Consequently, connected miscellaneous petition is closed.
