JUDGMENT

Today when the matter is taken up for hearing there is no representation for the appellant. A perusal of the records shows that the first respondent died in the year 2010 and till date no steps have been taken by the appellant to implead the legal heirs of the deceased first respondent. The appeal against the second respondent was also dismissed vide Court orders dated 21.12.2022.

2.In view of the above, the Second Appeal is dismissed for non prosecution. No costs. Consequently, connected miscellaneous petition is closed.
