JUDGMENT

This Second Appeal has been filed seeking to set aside the judgment and decree of the learned Additional District and Sessions Judge (Fast Track Court No.III), Chennai-1, made in A.S.No.594 of 2007 dated 31.08.2010 reversing the judgment and decree of the learned XVI Assistant Judge, City Civil Court, Chennai made in O.S.No.6451 of 1998 dated 24.10.2005.

2. On 05.10.2017, there was no representation for the appellant. Hence, the Second Appeal was ordered to post on 20.10.2017 under the caption "for dismissal".

3. Today (26.10.2017) also, there is no representation for the appellant. Therefore, the Second Appeal is dismissed for non prosecution. No costs. Consequently, connected miscellaneous petition is closed.
