..Respondent(s) PRAYER: Writ Petition has been filed under Article 226 of Constitution of India praying to issue a writ of mandamus directing the respondents to extend the benefit of the policy decision taken in G.O.Ms.No.151, Social welfare and Nutritious Meal programme Department dated 16.10.2008 to the petitioners who have been working as Multipurpose Hospital workers since 2013 on daily wages discharging onerous duties and direct the respondents to regularize the services of the petitioners in the post of Multipurpose Hospital workers and fix them in the time scale of pay within a period. ORDER
The petition has been filed to direct the respondents to extend the benefit of the policy decision taken in G.O.Ms.No.151, Social welfare and Nutritious Meal programme Department dated 16.10.2008 to the petitioners and also to regularize the services of the petitioners in the post of Multipurpose Hospital workers and fix them in the time scale of pay.
2. The petitioners are physically challenged worker and were appointed in the year 2013 and completed nearly 13 years of service. Till date, their time scale of pay was not fixed by the respondents. The government passed G.O.Ms.No.151, dated 16.10.2008 taking a policy decision to sanction time scale of pay for physically challenged persons who are working for more than two years in Consolidated pay. The said benefits were later extended to the persons working on daily wages basis by the orders of this Court.
3. Therefore, the petitioners made a representation to regularize their service in the post of Multipurpose Hospital Worker with effect from 2015 and fix their time scale of pay, for which, there is no response till date. Therefore, the petitioners are before this Court.
4. Heard the learned counsel on either side and perused the materials
available on record.
5. Considering the relief now sought for by the learned counsel for the petitioners, this Court, without going into the merits of the case, directs the respondents to consider the petitioners' representation, on merits, providing them a personal hearing and in accordance with law and to pass appropriate orders, within a period of eight weeks from the date of receipt of a copy of this order.
Accordingly, the writ petition is disposed of. No costs. Connected miscellaneous petition is closed.
