C.M.P.No.8211 of 2020 in CMA.Sr.No. 47454 of 2020 V.BHARATHIDASAN,J.

The petitioner/Appellant has filed this petition to condone the delay of 49 days in filing the appeal against the award passed by the Motor Accidents Claims Tribunal, Perambalur in MCOP No.314 of 2016, dated 18.10.2019.

2. Heard the learned counsel for the petitioner/appellant. The first respondent was set exparte in the MCOP itself. Mr.M.J.Vijayaraghavan, takes notice for the second respondent.

3. The learned counsel for the Second respondent has got no serious objection in allowing this petition.

4. Considering the submissions made on either side and being satisfied with the reasons assigned in the affidavit filed in support of this petition, the delay is condoned and this petition is allowed.

5. Registry is directed to number the Civil Miscellaneous Appeal, if it is otherwise the papers are found to be in order and print the name of Mr.M.J.Vijayaraghavan, for 2nd respondent and post the matter on 15.10.2020 for admission.
