Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the 3rd respondent to issue orders for grant of Patta on the basis of the order of the 2nd respondent bearing No.O.Mu.2050/2016 AA1 dated 19.07.2016.

Mr.V.Prabhu, learned Government Advocate takes notice for the respondents. By consent of the parties, this writ petition is taken up for final disposal at the admission stage itself.

2. The petitioner seeks for a mandamus directing the third respondent to issue patta, based on the communication issued by the second respondent dated 19.07.2016.

3. It is seen that the Revenue Divisional Officer, Mannargudi, through the proceedings dated 19.07.2016 informed the Special Deputy Tahsildar, Mannargudi, that nearly about 100 families are residing in Ward-I, Block 4, Town Survey Nos.96/1, https://hcservices.ecourts.gov.in/hcservices/

2, 3, 97, 98 & 99, Mannargudi Taluk and District and therefore, action may be taken on their request for grant of patta.

4. The grievance of the petitioner is that even though the said communication was issued by the second respondent as early as on 19.07.2016, till this date, the third respondent has not done anything.

5. This Court, at this stage, is not expressing any view on the merits of the claim made by the petitioner, as it is for the third respondent to consider and decide the same, based on the communication already issued by the second respondent. Accordingly, this writ petition is disposed of, only by directing the third respondent to consider the request of the petitioner, based on the communication already issued by the second respondent dated 19.07.2016, after hearing all the parties concerned. Such exercise shall be done by the third respondent within a period of twelve weeks from the date of receipt of a copy of this order. No costs.
