This Petition is filed to grant extension of time by a further period of 16 weeks from the date of order of this Petition to comply with the direction of this Court in CMP.No.3836 of 2021 in AS.No.226 of 2016 dated 23.02.2021.
2. No representation for the Petitioner. Learned counsel for the Respondent present. On perusal of the petition it reveals that in the Appeal Suit in AS No.226 of 2016 this Court had directed the petitioner to refund the advance amount as per the decree with interest within a period of four months from the date of receipt of copy of the judgement. But the petitioner received copy of the judgment only on 10.11.2020. Due to the pandamic situation she was not able to comply with the order passed by this Court within the time. Hence, the petitioner filed CMP.No.3836 of 2021 and sought 16 weeks time to deposit the amount. On 23.02.2021 this Court has granted further eight (8) weeks time to the Petitioner. But due to the second wave of covid-19 the petitioner being a widow she was not able to mobilze the funds and hence she filed this Petition and sought extension of time for further 16 weeks. Considering the reasons stated in the affidavit filed by the petitioner in support of the petition, this court is inclined to extend five (5) weeks time to deposit the amount, from the date of receipt of copy of this Order. If the petitioner is not complied with the order, further time will not be extended.
