O.P.No.337 of 2022 O.P.No.337 of 2022 C.V.KARTHIKEYAN,J., This Original Petition filed under Sections 218 and 278 of the Indian Succession Act, 1925, seeking letters of administration without Will relating to the estate of M.Sivakumar, the brother of the petitioner, who died intestate on 23.05.2021.

2. The petitioner and the deceased M.Sivakumar had a sister Parimala, who died on 23.10.2006.

3. It is stated that the petitioner is the only class-II legal heir. The parents had died in the year 1974 and 2018 respectively.

4. After following due procedure, the petitioner was invited to tender evidence.

5. The petitioner examined himself as P.W.1. The Death Certificate of his father was marked as Ex.P2. The Death Certificate and the Legal Heirship Certificate of his mother were marked as Exs.P6 and P7. The Death Certificate of his sister was marked as Ex.P5. The Death Certificate of M.Sivakumar was marked as Ex.P8. Ex.P13 is the order in the Writ Petition relating to the Land Acquisition Proceedings where the petitioner had received compensation payable to the deceased. 1/2 https://www.mhc.tn.gov.in/judis

6. In view of the evidence presented, the Original Petition stands allowed. Letters of Administration is granted to the petitioner. The petitioner shall execute a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) in the name of the Assistant Registrar (Original Side), High Court of Madras.
