This is a petition to condone the delay of 115 days in filing the civil miscellaneous appeal.

Mr. B. Sivaraman, learned counsel, who accepts notice for the sole respondent, submitted that he has no objection in this petition being allowed.

Satisfied with the reasons stated in the affidavit accompanying this civil miscellaneous petition and also considering the 'no objection' expressed by the learned counsel for the respondent, the aforesaid delay is condoned and this C.M.P. is ordered accordingly.

The Registry is directed to number the writ appeal, if it is otherwise in order.
