ORDER

The petitioner seeks a mandamus to direct the respondent to grant permission to conduct cultural and dance program during Shree Sakthi Mariyamman Temple Festival to be conducted on 13.05.2018 situate at Gandhinagar, Mullur Taluk, Salem District, by considering his representation dated 01.05.2018. Heard the submissions of the learned counsel for the petitioner as well as Mr.N.Manikandan, learned Government Advocate who accepts notice on behalf of the respondent. This Court, on perusal of the affidavit and the typed set of documents, is of the view that granting permission to conduct cultural programmes in public place is always subject to the peace and tranquility prevailing in the locality / village where such program is supposed to be conducted and also, the antecedents and locus of the person who seeks permission matters. This can be gone into only by the local/jurisdictional police. Hence, this Court is not inclined to entertain this writ petition. It is always open to the petitioner to approach

the jurisdictional police and if it is conducive, the authority concerned / jurisdictional police shall grant permission to conduct such cultural program subject to reasonable restriction. The writ petition stands disposed of with the above observation. No costs.
